Welcome to Thrivebot! These Terms of Service ("Terms") govern your use of Thrivebot, a Discord bot, and its associated website at https://www.thrivebot.in (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

📝 1. Service Description

Thrivebot is a Discord bot that provides various features including moderation tools, economy systems, games, utility commands, server verification (captcha-based), and other Discord server enhancements. The Service includes both free and premium features accessible through our website and Discord bot.

👤 2. Eligibility and Account Requirements

You must be at least 13 years old to use this Service, in compliance with Discord's Terms of Service and the Children's Online Privacy Protection Act (COPPA). By using the Service, you represent that you meet this age requirement.

To use certain features, you must have a valid Discord account. You are responsible for maintaining the security of your Discord account.

Thrivebot operates in accordance with Discord's Developer Policy. We do not collect, use, or store data beyond what is disclosed in our Privacy Policy and permitted by Discord's terms.

⭐ 4. Premium Subscriptions

We offer premium subscription plans that provide enhanced features and benefits. Premium subscriptions are subject to the following terms:

• Payment: Premium subscriptions are processed through our payment processor, Lemon Squeezy
• Billing: Subscriptions are billed on a recurring basis (monthly or as specified) until cancelled
• Pricing: Current pricing is displayed on our Pricing page
• Cancellation: You may cancel your subscription at any time through your account settings
• Refunds: Refund policies are outlined in our Refund Policy
• Changes: We reserve the right to modify premium features and pricing with notice

🪙 5. Virtual Currency and Goods

Thrivebot includes a virtual economy system ("coins", "items", "xp"). BY USING THESE FEATURES, YOU AGREE THAT:

• No Real World Value: Virtual currency and items have absolutely no real-world monetary value. They cannot be exchanged, sold, or redeemed for real money, goods, or services from us or anyone else.
• Not a Bank: We are not a bank, financial institution, or cryptocurrency exchange. The economy system is purely for entertainment purposes.
• Right to Modify: We reserve the absolute right to manage, regulate, control, modify, or eliminate virtual currency and items at any time, with or without notice. This includes resetting economy data ("wipes") to ensure fair play or apply updates.
• No Ownership: You do not own the virtual currency or items; you merely have a limited license to use them within the Service.

🛡️ 6. User Conduct and Acceptable Use

You agree to use the Service in compliance with these Terms, our Acceptable Use Policy, and all applicable laws. Prohibited activities include, but are not limited to:

• Using automated means to interact with the bot (botting, scripting)
• Cheating, exploiting game mechanics, or abusing bugs
• Harassment, abuse, or threatening behavior toward other users
• Distributing spam, malware, or harmful content
• Attempting to gain unauthorized access to the Service or user accounts
• Violating Discord's Terms of Service or Community Guidelines
• Engaging in illegal activities or violating intellectual property rights
• Impersonating others or misrepresenting your affiliation

Violation of these terms may result in suspension or termination of your access to the Service.

The Service, including but not limited to the bot code, website content, graphics, logos, and trademarks, is owned by the individual operator and is protected by copyright, trademark, and other intellectual property laws.

License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

User Content: You retain ownership of any content you submit through the Service. By submitting content, you grant us a license to use, store, and process it as necessary to provide the Service.

The Service integrates with and relies on third-party platforms and services, including:

• Discord: Subject to Discord's Terms of Service and Privacy Policy
• Lemon Squeezy: Payment processing subject to Lemon Squeezy's terms
• Cloudflare: CDN and security services
• Google Analytics: Website analytics (only with your consent)

We are not responsible for third-party services' availability, functionality, or policies. Your use of third-party services is subject to their respective terms.

We reserve the right to:

• Modify, suspend, or discontinue the Service (or any part thereof) at any time
• Change features, functionality, or availability of the Service
• Update these Terms with notice to users
• Terminate or suspend your access for violations of these Terms

We will provide reasonable notice of material changes where feasible, but are not liable for any modifications or termination of the Service.

• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties regarding the results obtained from using the Service

We do not guarantee uptime, data integrity, or that the Service will meet your requirements. You use the Service at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE INDIVIDUAL OPERATOR OF THIS SERVICE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers or any personal information stored therein
• Any interruption or cessation of the Service
• Any bugs, viruses, or harmful code transmitted through the Service
• Any errors or omissions in content or any loss or damage incurred from using content
• Any conduct or content of third parties using the Service

IN JURISDICTIONS WHERE LIMITATION OF LIABILITY IS NOT PERMITTED, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR $100 USD, WHICHEVER IS GREATER.

• Your violation of any rights of another user or third party
• Your content or any content submitted through your account
• Any dispute between you and another user

⚖️ 14. Dispute Resolution and Governing Law

Governing Law: These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. For users outside India, local consumer protection laws may also apply and shall not be excluded by these Terms.

Informal Resolution: If you have a dispute with us, you agree to first contact us at support@thrivebot.in to attempt to resolve the dispute informally.

Jurisdiction: You agree that any legal action or proceeding relating to these Terms or the Service shall be brought in courts of competent jurisdiction in India, and you consent to the jurisdiction of such courts. However, we will not object to jurisdiction in your local courts if required by applicable consumer protection laws.

For EU Users: Nothing in these Terms affects your statutory rights as a consumer under EU law, including your right to bring proceedings in your country of residence.

We reserve the right to modify these Terms at any time. Material changes will be communicated via:

• Announcement in our Discord support server
• Notice on the website (for significant changes)

Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.

📝 16. Miscellaneous Provisions

Entire Agreement: These Terms, together with our Privacy Policy, Cookie Policy, and other referenced policies, constitute the entire agreement between you and us regarding the Service.

Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, pandemics, or internet service failures.
